Bookings: Terms, Conditions & Acknowledgement of Risk
1.Beach Bum Surfaris is a family operated Learn To Surf , Surf Experience & Day Tours operator.
2.Bookings made through Beach Bum Surfaris and associated deposits are strictly non-refundable in whole or in part however they are fully flexible and may in most cases be exchanged to be used towards another Surf Lesson or Tour offered subject to availability.
3.Changing your booking at any time may incur a $50 per person administration fee. Bookings may also be transferred to another person and will also incur a $50 per person administration fee. Changes to your Surf Surfari booking require a minimum of 48 hours written notice prior to the booked date. No changes are permitted within 48 hours of the date of your booking.
4.A credit card transaction fee of $3.50 will apply to each booking. A $20.00 fee will apply to any credit card chargebacks.
5.If you fail to show at the booked time, or on the booked day, of your Surfari we cannot offer a refund or a credit towards another Surfari or Tour.
6.All participants / customers of Beach Bum Surfaris acknowledge and agree that, upon booking a Surfari or Tour through Beach Bum Surfaris, they may be required to sign an Acknowledgement of Risk, wherein the Participant releases Beach Bum Surfaris from any liability with respect to any injuries, loss or damages which may be sustained by the Participant / Customer in the course of undertaking any Surfari or Tour, whether dangerous, hazardous or otherwise. If you are under the age of 18, you may need to have a parent or guardian sign the Acknowledgement of Risk on your behalf.
7.The Participant / Customer unconditionally agrees to fully indemnify Beach Bum Surfaris and all its servants, agent's, clients and employees against any injury, damage or accident that may be sustained by the Participant / Customer, whilst participating in Surfaris or Tours booked through Beach Bum Surfaris or the entities and accomodation outlets who offer various services to Beach Bum Surfaris.
8.The Participant warrants that he/she does not suffer from any Medical Condition and/or incapacity which may impair the Participants ability to participate in Beach Bum Surfaris Tours / Activities and further, that the Participant / Customer does not suffer from any Heart Condition, Epilepsy or other Medical Condition which may result in the Participant potentially placing himself/herself in a position of risk, by undertaking activities booked through Beach Bum Surfaris.
9.Beach Bum Surfaris and its partners reserve the right to cancel a Surfari Tour at any time in the event of adverse weather conditions, equipment failure or other reasonable and unforeseen circumstances. In such an event, an alternative date will be arranged with the Participant. No refund will be available.
10.Certain Surfaris/Activities require minimum participant numbers for the adventure to take place. If minimum numbers are not met, Beach Bum Surfaris will contact you to arrange for an alternative date.
11.Beach Bum Surfaris will not be responsible for any loss, injury or damage incurred or suffered by the participant during the Surfari.
12.In the event that the Surfari or Tour is cancelled or postponed for any reason, the Participant / Customer agrees to reschedule another date or, where possible, exchange for another Surfari / activity. Bookings made through Beach Bum Surfaris and associated deposits are strictly non-refundable in whole or in part.
13.The Participant / Customer pledges that no legal action will be initiated by it against Beach Bum Surfaris, its clients, its agents, employees, instructors, and/or personnel, due to any accident or injury sustained during the course of undertaking an Surfari or Tour booked with Beach Bum Surfaris.
14. All 3rd Party Resellers and Agents responsible for selling Beach Bum Tours, Activities and Experiences acknowledge payment is required prior to Tour , Activity or Experience departing or within 7 days of receipt of Invoice unless otherwise organised.
15. Any and all Beach Bum Tours, Activities and Experiences sold prior to departure are made commissionable to the Agent or Reseller. All other Tours, Activities or packages sold by Beach Bum after departure are non commissionable.
16. In the event that your Surfari/Tour booked with Beach Bum Surfaris was purchased on your behalf by another person, you warrant that the purchaser acted as your agent in doing so with your express authority and as such, consented to the terms and conditions of sale on your behalf. If you purchased a Surfari/Tour on behalf of other individuals or members of a group, you acknowledge that you have acted as an agent for those individuals or groups and accept the terms and conditions of sale on their behalf with their express authority to do so.
17.The terms and conditions of sale contained herein may be added to or supplemented by further oral terms, conditions and directions provided to you prior to and during the adventure / activity.
